Colombia, entre los TLC y la OMC: ¿Liberación o adminsitración del comercio internacional?

The regulation of markets in the context of economic globalization day after day brings new challenges and complexities. Today, in the scenario of trade wars between the major participants in international trade, we find the questions that this book will try to answer: Under what conditions are we participating in trade liberalization, and what benefits and costs for the social rule of law have been derived from this liberalization? To understand these questions, this work is based on a reality of globalization, the existence of a greater propensity for conflicts of rules or obligations in commercial matters, more specifically the law of the WTO and the FTAs concluded by Colombia, with other provisions of the law. international standards such as environmental, human rights, labor, community, regional standards, etc. Here, the proliferation of international instruments and their constant interaction undoubtedly make it more difficult to find answers in an ocean of obligations contained in treaties that are normally independent of each other and have the same legal status.

Taking into account the above, this book aims to identify some problems of the international trade system, or at least those that affect Colombia, V presents some solutions based on the principles on which this system is built, such as the principle of non-discrimination, without forgetting the principles that are the foundation of international relations in the Colombian social State of law, such as the principles of reciprocity, equity and national convenience.
