Los sujetos no signatarios en los contratos coligados
The complexity that often occurs in the contractual framework of linked or related contracts means that in the event that the parties involved want to defer the solution of their disputes to arbitration, it is difficult for all of them to be bound by the same arbitration contract. Even if there are cases in which certain subjects, despite being involved in the controversy that arises in relation to one or more of these contracts, are not a formal party to the arbitration agreement.
In the present investigation, the feasibility of extending the effects of the arbitration contract to non-signatory subjects in the case of linked contracts is studied, and the conditions under which said extension would proceed, both from the perspective of international arbitration and national arbitration and to the light of the Spanish and Colombian legal systems.
