The purpose of this essay is to study the protection of consumer rights and, in particular, the role of consent as the axis of the guarantee of such rights. In this sense, it is very useful to direct the protection towards the synallagma as the substantial founding structure of the contract, and not understand it as mere consent, which in the field of consumption has been reduced to the acceptance or not of the consumer to contract.

This change in conception means redirecting consumer rights to the general categories of protection inherent to the contractual system, as one more relationship that justifies the protection of the weak party. For this reason, this essay recognizes that the consumer contract is subject to the requirements of balance, information, advice, prohibition of any type of abuse that results from the dominant position of the person who has greater negotiating powers, etc. In effect, the authors carry out a re-reading of one of these requirements: the duty of information, as a remedy that contributes to the formation of valid consent and the correct execution of the benefits of the contract, which results in fair and balanced business relations.
