Extractivism, Transnational Corporations, and Human Rights: In Search of Justice proposes a new litigation strategy for cases of human rights violations occurring in Latin America and involving transnational corporations in the extractive sector (mining and hydrocarbons). The proposal consists of involving the States of origin in the litigation, since these States have the tools to regulate the activities of their companies, even outside their territory.
To this end, the author reviews the cases decided by the Inter-American Court of Human Rights involving transnational corporations and draws on the foreign investment protection regime, the jurisprudence of the International Court of Justice, as well as decisions adopted by the United Nations Conventional Committees and developments within the European System for the Protection of Human Rights.
