Currently, studies in the philosophy of law and legal theory are not guided by a single problem that determines their subject matter, but rather by a multiplicity of more or less abstract questions and concerns, which are addressed from diverse theoretical perspectives.
The philosophy and legal theory of the German tradition are no exception. While problems of the ultimate justification of law have occupied a central place in these disciplines, attention is now directed to other issues arising from alternative approaches to law, such as hermeneutics, argumentation theory, logic, sociology, economic analysis of law, or studies of psychology and law.
Under these conditions, American professor James Herget undertakes the task of describing this panorama as clearly and precisely as possible. With the ingenuity and wonder of a foreigner who, nevertheless, tries not to fall into prejudices, the author recounts different theoretical currents current in the German milieu.
In turn, He details those theoretical developments that can be considered typically German, insofar as they share common theoretical problems and concerns. On the one hand, this allows him to establish common ground between seemingly incommensurable developments and, on the other, to contrast them in general with Anglo-Saxon legal theory.

Profesor asociado de la Facultad de Derecho de la Universidad de los Andes, doctor en Derecho (SJD) de la Universidad de Harvard, magíster en Derecho de la Universidad de los Andes y abogado de la Pontificia Universidad Javeriana. Su trabajo de docencia e investigación se concentra en la teoría y la historia del derecho, derecho y literatura y los derechos humanos. Dentro de sus publicaciones más reciente se encuentran las novelas La incierta forma del tiempo (Ediciones Uniandes, 2023) y Los escombros del exilio (Taller de Edición Rocca y Ediciones Uniandes, 2024), así como el libro Revolución, democracia y paz. Trayectorias de los derechos humanos en Colombia, 1973-1985 (Tirant lo Blanch y Ediciones Uniandes, 2019).
