La Vigencia del Código Civil de Andrés Bello.

Andrés Bello's Civil Code is a code indigenous to Latin America, which compiled the rules of our legal tradition, supported by the general principles of law, which were then refined and developed to reflect our experience as Latin Americans. It is a code that has survived due to its clarity, precision, and conciseness in its wording, as well as the institutional form it presents in the legal framework governing private relations.

However, the Code is constructed based on a universal and national mentality, method, and circumstances different from those of today, which leads us to reflect on whether these rules respond to the challenges of contemporary society. This is especially true when there is a reform movement influenced by recent civil code reforms around the world, such as, for example, the 2016 reform of the French Civil Code and the enactment of the Civil and Commercial Code of the Argentine Republic in 2015.

This book is the work of research professors who have analyzed the validity of Andrés Bello's Civil Code in the Latin American legal system, but through some of the rules contained therein, taking into account the particularities of current private relations and new social and economic contexts and realities. To fulfill the objective of analysis, the book is divided into four parts: the first deals with the validity of Andrés Bello's Civil Code in the Latin American legal system and some reform experiences in Colombia; the second deals with family law in Andrés Bello's Civil Code in contemporary society; the third analyzes the interpretation and integration of contracts in Andrés Bello's Civil Code in light of the new challenges of contracting; And finally, the fourth part addresses civil liability regimes in the face of the challenges of modern society, examining two specific cases: liability for dangerous activities and the liability of employers for the actions of employees.

Thus, the first part highlights the institutional model of Andrés Bello's Civil Code and its usefulness: it is a code in which the individual plays a central role, and the provisions are presented in a didactic and understandable manner. All of this makes it a reference model when studying private law and its challenges, and, in the event of a reform, it should be taken into account in the preparation of a potential new code project.
