Las obligaciones alternativas en el derecho latinoamericano
Un análisis a partir de la regla de integridad del pago. Ensayos de Derecho privado n.° 6
The classification of obligations is a classic topic in the study and teaching of civil law, which has a favorite place in obligation manuals. The study that is done with manuals, however, often must sacrifice the depth of the analysis or the very approach to certain problems.
This study on alternative obligations aims, precisely, to address a specific problem that has not been addressed in the Latin American manual on obligations - the rule of integrity or completeness of payment in alternative obligations - and proposes an interpretation that allows rescuing the function of this type of obligations in Latin American law.
Taking into account the efforts to harmonize the Law on obligations in Latin America, for example, those carried out by the Group for the Harmonization of Law in Latin America (GADAL), this study is very timely, since it analyzes a present rule in most Latin American codifications, the true scope of which has gone unnoticed in the respective systems.
