In this work, two bets are combined: one of a theoretical order and another of an ethical order. From a theoretical point of view, a positivist characterization of rights is presented. In this sense, the artificiality of law is highlighted, an indispensable tool for guaranteeing rights, and the conditions of meaning of the pragmatic dimension of legality are made explicit. From an ethical point of view, it is assumed that a morally decent society is one in which legal powers take precedence over illegal powers. Legal power, in this way, will only be admissible when it acts tied to the limits and bonds that are imposed on it. The ethical commitment, at that time, is not detached from the theoretical commitment: legal positivism is the theory that appears most compatible with guaranteeism. The effectiveness of the laws of the weakest depends on guarantees prevailing, and for this legality must be a shared value.
